It is not a tomato plant.

It's marigold. Lanceolate, sharp serrations on leaves.

Thanks for clearing that up. That's the way I was leaning but you know tomatoes-----once you have them they reseed everywhere

Marigold. Rub and smell the leaves. Even if you can’t id from the foliage the smell of the two plants is very strong and totally distinctive. Scent is an often overlooked aid in plant identification. As is texture.
