Is this your main patio area or is there a main patio to the right that you aren't showing us? If this is your main patio area, then I would definitely fill it in or put flooring over it. Does it drain properly when it rains?

That is an accident waiting to happen. I hope you've upped your homeowners insurance if your husband wants to keep it. And it's not even remotely attractive looking or comfortable looking.

Raised deck over the whole area or fill in the sunken area with a flush deck and a really big outdoor rug to hide the transition, looks like it would be a great location for a real seating area

definitely not a spa, I can see a power outlet near the bottom. what a bizarre style choice that builder made. uncomfortable, unsafe, and hard to keep clean (do you use a vacuum in there?). Normally I like the idea of composite decking like chispa suggested. But dirt and water will slip through and collect at the bottom -- who knows what kinds of issues that may cause over time. I would have it properly filled in.

How old is the property? Reminds me of a 1970's era sunken conversation put. I agree that it should be filled in.

Do you have kids or plan on kids in the future? Or have grandchildren? If you do, that alone should be the reason to fill it in.
