I don't think you want to mix tenacity into the soil. Most weed seeds need sunlight to germinate, so you want it to be on the surface with the seeds.

Don't know where you are, but in the northern hemisphere, this is a bad time to try to establish a fescue lawn from seed. It will struggle a lot to survive the summer. Best time to put down fescue seed is in early fall.

So i should use it on top of the cultivated soil before seeding you think?

Bermuda grass spreads easily and over time should choke out any weeds. In bare spots, you can pull out plugs in good spots and plant them in the bare spots to speed up the process. Your best option is likely to improve the health of your current lawn. Do you dislike your current grass?

According to the manufacturer, Tenacity can be used up to the date of seeding or overseeding.

" With few restrictions around applications, Tenacity may be applied to labeled turfgrasses anytime up to during seeding, but prior to emergence and four weeks after emergence. Tenacity is one of the few herbicides that controls weeds during the seeding process and provides pre-emergent and some post-emergent control of many weeds."

If your neighbors have moles and weeds, you get them too, unless you douse your lawn with chemicals on a regular basis.
