There is another thread on the topic of Etsy sellers and the legal and moral implications of importing and distributing roses under patent without permission.

My understanding is that Pink O’Hara is exclusively licensed to Grace Rose Farm for US distribution which doesnt say much for Zephyr Gardens business practices. Not to mention all the Japanese roses they have listed which are likely still under patent as well with no mention of this or how they got rights to distribute anywhere on their website that I could find.

Y’all are nuts here. I literally said I’ve never bought from a site like this before. Grace is no longer producing own root roses. I could’ve bought a bouquet of them and grown it myself.

I’ve noticed what once was Gardenweb has become toxic, riddled with people asserting their opinions on others as if it’s gospel. Next time I’ll buy a bouquet, grow a dozen own root and distribute them to all my neighbors.

Btw - every time you screenshot a meme or photo without recognition to the creator- you’re stealing and distributing artwork without a license.

Well, let's wait a minute. Grace Rose Farm has exclusive rights for US distribution for Pink O'Hara, and the rose in the photo looks like it has at least 6-8 months of pot growth from the cutting stage. How could Zephyr Gardens get propagating material to produce such a mature rose, and got the propagating material (cuttings, starts in cubes, tissue culture starts, etc., sometime last fall/ winter 2023/24? Would they not have to had contacted Grace Rose Farm and made a deal with them, possibly legit, and paid the necessary royalties?

Pink O'Hara is a 2024 release, right? Am I missing something in my assumption that it looks like there is no scam going on?

Moses, I didn’t say anything about a scam, based on reports from other that have bought from them the roses are correct. It’s just that as far as I am aware the rose is exclusively licensed to Grace Rose Farms in the US with propagation prohibited so for Zephyr Gardens to be selling the rose without explaining how they got the right to do so seems problematic. The fact that there is no information about the breeder or any details about the source of the rose is a red flag to me. I believe GRF has been selling bouquets of Pink O’Hara for some time so getting cuttings from a bouquet is entirely possible in this time frame.

I actually personally have no issues with propagating cut roses you have bought for your own use even if it’s technically not legal but I do have issues with these sellers who are making money off these roses without getting permission from the patent holders.

At the risk of being accused of negativity and yielding a pitchfork (which I actually do quite a lot of in the garden!) this appears to be one of the Etsy sellers that has apparently been sued by David Austin.

I don’t mind people chiming in with ideas, and alternative points of view. However, there’s people on here who are truly sanctimonious and rude in their delivery. I bet they’re a joy to be around in real life.

I’ve just returned to this forum after an 8 year hiatus. Now I remember why I left. I’ve spent several years around ARS shows and even highly experienced growers/showers don’t act or speak like this. The internet is great but, it gives people a wall to hide to behind and be awful to others.

Hu, if I came across as sanctimonious and rude earlier I apologize. I have been away from the rose community for almost five years and while I was aware of the rise of Etsy sellers I hadnt realized it had become such a controversial topic. My comments were in good faith but I realize now in context of the larger discussion they were uneccessary here.

Well, goodness me, bart bart. I remember the badger spat very well but had no idea you'd changed your mind. All these years I've avoided responding to your posts about your Italian garden for fear of getting my head bitten off again! Thanks for the update. 😊

I stay away from the Rose Forum because a. I don't grow roses and b. It has acquired a reputation.

@Heather RR - the Etsy seller topic shouldn't be controversial at all. That is where the problem lies, not with anything you said.
