Collecting migratory bird nest is illegal under the Federal Migratory Bird Act. It is an offense to possess them without a permit. See http://www.npwrc.usgs.gov/about/faqs/birds/feathers.htm

    I appreciate your concern. The egg is 100% fake, and the nest was actually found abandoned on the ground of our patio, it had fallen from one of the eaves of our roof and was laying on the ground completely abandoned.

    It's good that it was abandoned, however, it is still illegal to possess. The Federal Migratory Bird Act does not distinguish between possession of nests obtained under any means, abandoned or not. Check with your local game warden if you need more info.

    Seriously, there are people dying from starvation and someone is worried about a pile of grass found on the ground? My yard man would have mowed right over it. Geesh, like the sparrows dont rebuild nests every spring??

    By the way, I have two in my livingroom, they were knocked out of the trees, empty, by birds building new nests, they are on my property and I own them.
