Small 2 tiered pond at base of tree

We bought these retaining wall blocks to form a small pond next to our patio/deck area. I placed the blocks kind of how I wanted them, although they are not permanent. The top pond area will have to be small and can't be dug too deeply because of tree roots. I would prefer a waterfall-type instead of a spitter but want some kind of spill over to the lower pond. I like the look of the back wall in the blocks, although they are certainly not set the right way in the picture. We will, of course, be getting black pond liner and capstones to finish it off. Just wondering how to set up a smaller pond of some kind on the top without a lot of room to dig it out. The area around the top that has plants now could be covered in more natural stones to surround the waterfall area once it's built. My once strong and very handy husband was going to put all of this together for me this summer, but since he contracted West Nile virus last fall he is still disabled and not strong enough to do it.... he nearly lost his life to it but now he's starting to get around with a 4 wheeled walker. If anyone is handy and would like to take on a small job like this in the Livonia MI area I would be very happy to hire you!
