pruning young tree

So I purchased a small tree from an online retailer and it arrived today. After unboxing it I noticed that very, very low on the tree near dirt level, the is a fork and a substantial branch/trunk forming.

It's a sourwood tree and going to be used as a street tree so this condition isn't acceptable. Should or can I remove the low trunk at the V? Are there an long term problems that can occur from this measure? Should I complain and return or deal with what was sent?

Thanks for the help!
