According to the NEC which is practically everywhere in the US;

410.6 Listing Required. All luminaires, lampholders, and retrofit kits shall be listed.

410.10 Luminaires in Specific Locations

(A) Wet and Damp Locations. Luminaires installed in wet or damp locations shall be installed such that water cannot enter or accumulate in wiring compartments, lampholders, or other electrical parts. All luminaires installed in wet locations shall be marked, "Suitable for Wet Locations." All luminaires installed in damp locations shall be marked "Suitable for Wet Locations" or "Suitable for Damp Locations."

Listing requirements for low voltage include whether or not the luminaire and parts are damp or wet rated.

In other words, a luminaire being of a low voltage type does not make it damp rated. It still must be listed for damp locations.

The reality is that low voltage lighting around water can be more dangerous than 120 volt systems. One reason is that the low voltage system can not be protected by a GFCI. In fact, when lighting is around a swimming pool, 120 volt lighting with GFCI protection can be installed closer to the edge of a pool than low voltage lighting.
