That almost looks like a Red Tip Photinia (Fraser's Photinia) to me. If it is, they get very large. We have them everywhere in North TX.

I think you are right. It looks similar to the pictures of those kinds of plants and I have seen several with that bright red. I read that they have a smelly flower. I guess the one I have is too young to have a bloom.

I don't mind the smell of the flowers actually! Ours bloom a lot in Spring, and I even cut them to bring inside sometimes. A lot of people here trim and shape them, but you can let them grow wild also and they end up looking like a small tree.

We live in Savannah, and our neighbors let theirs grow to be thirty feet tall. The nicest week of spring is always ruined by the smell of rotting flesh from an otherwise attractive plant.

Greendesigns is right; it's a Cleyera. (Photinia new growth is bright red and you should actually be very glad that it is not a Photinia given their predilection to disease.) Builders use Cleyera often as they are indestructible and can survive in dry shade. They really need very little care but will appreciate occasional fertilizer (not too much) and regular watering.
