FWIW, that's not oak. Perhaps birch or poplar with a cherry stain, maybe, if you're lucky, cherry. To get rid of the scratches you almost have to sand, and if you sand through the stain (assuming it is stained and not actually cherry) you'll have trouble color matching. You'll want to sand using a random orbit sander no coarser than 80 grit (try 100 or 120 first) to sand out the scratches, then 150 and 220. Use each grit in turn, skipping just causes problems. I'd refinish with an oil-based polyurethane varnish. I'm sure the poly haters will suggest other kinds of varnish, they are also fine.

Yeah I guess your right! I assumed everything was oak but these dont have the grain.

you could just put another coat of poly over it if the scratches are not to deep.
