Should we cut this tree down?

Last summer the leaves were dropping fast and we noticed a couple of dead branches. This is how it came back this Spring. We contacted the place we bought it from 5 years ago and they said it's from lack of water and should come out of it. But, I don't know...doesn't look good...Thoughts?

    I thought so. By now it should have established and resumed normal growth. It is in decline and probably won't recover enough, if at all, to make an attractive specimen. Cut your losses and remove it, and start over with a tree at least half that size or smaller.
