Building pool on non virgin ground

6 years ago I subdivided my property. On the side yard of the old house, there was an in-ground pool that needed to be removed. That old side yard, is now my new side yard. All of the dirt from my new house was back filled into where the pool was. I had a pool company come out to give me an estimate. After we told them that there was a pool there years ago, we were told that it may be a problem to build on. We were told we may need pilings and it could cost just as much as the pool. That is definitely not an option for us. They're going to come and test the soil and I'm feared we may not be able to build. Are there any other options? Besides getting an above ground pool. Thanks!
