New growth above graft point?

I planted some fruit trees this spring and some of them did poorly, I've got an apple tree where the top half of the tree died but it looks like the roots did not. There are new buds an leaves sprouting from the base ABOVE the graft point. Is that OK you think? Should I cut the top off and make that the new whip?
