this is how we are fire blocking. but when running parallel to joist our fireblock is coming out past the joist so it is then boxing in the long rim joist area and making inaccessible to spray foam.

I found this pic online which is similar to our issue. this one leaves just a tiny gap, not enough to spray foam through...

I tried to draw out the problem...

Fire blocking is used to stop the spread of flame. Insulation is often used for the same.

Is fire blocking required or is it really a draft stopping requirement? Draft stopping is to prevent fire, smoke and/or hot gasses from moving vertically up through the walls and floors. This can be done with fire blocking or drywall, insulation, etc. Its good to ask the inspector what they will accept, especially if you want insulation values.

Same code everywhere. Is there a pro involved? Your label is "firestop" not "fire blocking"
