Since you already asked MI Homes, If you have a legal contract with MI Homes, what you can and can not do is in the contract and any advice concerning the contract is best received from your attorney that has read the contract.

Some states have instituted some special Covid19 exemptions for different things, so depending on where you are and when this happened you might be able to back out of the whole deal. Might be worth looking into it.

In my area of CA people were able to back out of home purchases for any reason when the lock downs took place. A few sales did fall through, but most closed. Of course, if you make an offer now, then that exemption doesn't apply.

A contract is an agreement between parties. It can be modified if both agree. Ask to change at no cost. Then, if necessary, ask how much will be required to change your model. It may be less than where you are now.

If you have a fully executed contract, you can back out and forfeit any earnest deposit or if no actual work has commenced, possibly change plans. But it will most likely cost you more. I think you are looking a saving pennies instead of choosing plan you want and paying fair price. To state this builder is using “gimmicks” at this early stage doesn’t bode well for building a trust relationship with your builder. I suspect this will be a rough ride. Think hard about building.

Any modifications to your written contract must be in writing and signed by all parties. Don't just send an email, text, or agree on the phone.

And so i researched a little more. In one community both MI homes and Taylor Morrison sell homes. MI is charging 21k for a bonus room and Taylor Morrison is charging 12500 for the same. Mind you its the the same community, same floor plan, same sq ft. Can i now call it a gimmick.

Because by now a person has already entered the contract and its too late to backout at the bonus room pricing analysis u did!

@Deepti Nemani - You are using flawed logic when you compare a bonus room from one builder to another in the same community and expect them to charge the same amount. Each builder is going to have their own pricing structure, their own profit margin and their own costs even if they are in the same community. That doesn't mean that it is a gimmick. It means that each builder uses their own costs to determine the price at which they will provide you the bonus room. Are there differences in sizes and/or location of the bonus room? That contributes to the cost quoted. Also demand for the room figures into the added cost.

If you are suggesting that all builders in a given community need to price their homes the same and their "extra's" the same, not only is that an unrealistic expectation, it is pretty much heresy IMO. Why would builder A have to charge the same thing as builder B? The consumer has a choice between builders. If the builder is telling you that the contract is in force and he won't change the floorplan to the one you want now, then cancel your purchase agreement. This is the beginning of a long road. You already are dissatisfied with the builder and his product and this is the beginning. As someone else pointed out - it's going to get worse from here. Seek out a consultation with an attorney and get your options. Think long and hard about what is best for you and your family and then do that. I wish you well. Building, even with a production builder, isn't easy.

I sincerely doubt that MI Homes and Taylor Morrison are selling the same floor plan in the same community. Home builders often use the same floor plans in various communities that *they* are building, but home builders don't share floor plans with other home builders.
