Condenser fan always on, incorrect wiring?

My condenser fan motor was replaced prior to moving in to a new unit. I noticed the condenser fan is always on at all times even when off at the thermostat. I opened it up and the fan is spinning in the correct direction and speed. Everything else seems to run fine. There's no crankcase heater. It is a 3 wire fan motor. I have a 1.5 pole with shunt contactor. I noticed that 2 of the fan motor wires (black and yellow on top) are connected to the L1 and L2 positions which is the same side as my line wires from the disconnect shown in the pic. The brown wire is in the correct position of the capacitor. Is this wired appropriately? Will get a professional hvac opinion as well.

Does your thermostat have a setting for Fan On (versus Off and Auto)?

@sktn77a thanka for your response. Yes the thermostat is a nest 3rd gen. I've tried setting it to both auto and off positions with no luck. I called several hvac companies but due to the recent snow storm they can't come out till later this week.

Condenser fan is outside at the compressor. It does not turn on if a thermostat Fan On setting is engaged ... unless the compressor is also running.

The evaporator fan is inside, at the air handler / cooling coil unit. It does operate via the Fan On thermostat setting.

I should add that this central air condenser is a thru the wall condenser model 24wcu-10ab by first company. The fan motor is packard 82201 of that helps.

It it sounds like the fan was wired incorrectly when it was replaced. The contactor should be switching the power to the fan. It is not then the connection needs to be moved to the switched side.
