Condenser fan always on, incorrect wiring?

My condenser fan motor was replaced prior to moving in to a new unit. I noticed the condenser fan is always on at all times even when off at the thermostat. I opened it up and the fan is spinning in the correct direction and speed. Everything else seems to run fine. There's no crankcase heater. It is a 3 wire fan motor. I have a 1.5 pole with shunt contactor. I noticed that 2 of the fan motor wires (black and yellow on top) are connected to the L1 and L2 positions which is the same side as my line wires from the disconnect shown in the pic. The brown wire is in the correct position of the capacitor. Is this wired appropriately? Will get a professional hvac opinion as well.
