The home is complete and ready to occupy with a C/O "certificate of occupancy. Yes. Often, the pool can't get completed & filled without the home at this stage anyway.

Lender inspects when you request draws & final inspection plus often requests a review for liens or a filed notice of completion (depending on state) to notify all suppliers their lien clock is starting. Builder will want to get paid 100% unless they are responsible for the pool.

If it were me, I'd be moving in. It may be a minor & common issue for lenders.

When we got our CO in Florida and moved in, it took the bank another month to get their act together to convert the construction loan to a mortgage and then do the closing. It shouldn’t matter at all.

Zombie thread but for anyone later searching, I am a lender who does a fair amount of construction lending and my employer would not care as long as your insurance policy and the county allowed occupancy. This rarely happens since most builder contract require final payment within a certain number of days of the CO being issued, so anyone with a scenario like this where significant work will remain after the CO should talk to their builder up front about payment to make sure everyone is on the same page.
