No, not topsoil, you need an expert to come out and recommend proper fill layers and determine a proper grade away from the house. They may suggest a French Drain...this area looks really low and as you said, water will cause foundation issues. Which is another thing to check. Good thing you discovered this.

Licensed Contractors familiar with Foundation work, Grading and Drainage. Have them come out to assess the house and lot. They determine the overall slope to the edges of the property lines. Start with a quote so you get a clear understanding Ask questions and listen. It may be something simple.

Then if you decide to DIY, YouTube is great for how-tos on French Drains...you may already have a great slope.

The gravel yard where you order the materials is a great resource for info and on the job tips. They may have someone who can come out or recommend someone. You're gonna need at least a yard of fill ..so hard to tell from a photo.

When you dig down it looks dry, that's very good so is foundation. Backfill and topsoil garden ·layer by the photos but we can't see the grade.

You can't really tell what the grade is doing with a rail type level. Use a water level, please.
