Kitchen Appliance Order - Help with contract

We began a kitchen remodel with a local design/builder in September 2022. We signed an appliance package for all of the appliances in March 2023. We put a 40% deposit down to place the order with a Subzero/Wolff retailer. The new start project date is September 2024. We want to get out of the contract with the design/builder because we are not happy with them. The pricing from our builder is the full retail price on everything. The builder said that the appliances came in and that they are stored in their basement. I don't want the product after it has been stored there for over a year now. I also don't want to work with this firm anymore. I am surprised that they accepted delivery without full payment. I feel like we are being hustled and not being told the truth.

    Sub Zero doesn’t do discounts. Of course you are paying retail. So is everyone else.

    SZ/Wolf is UMRP pricing. No discounts. Not sure why you think you should be getting one??


    Breaking a contract involves discussing that contract with the lawyer who vetted it before you signed it. Yes, you will have to pay to complete the purchase of all of the materials contracted for and ordered. There is also the fee for the design work and any construction labor already done. You may also be ordered to reimburse the contractor for the job profits they expected to earn on the job.

    In regards to your appliances that are being stored, I would be less concerned about the fact that they have sat for year, but would be more interested to know when the warranty clock begins to tick. This is very important, because all appliances can be costly to repair. Whether you continue to use, these folks is another issue best left for legal advice, but look over your contract and check with Subzero wolf to see when your warranty calendar begins and ends. If it starts when your appliances were purchased, that could be an issue.

    Thank you! We have written checks that total six figures. I must be mistaken because I thought that builders receive a discount on the appliances and can pass that on if they want? The builder was supposed to start March 2023, then moved it to September 2023, then moved it to March 2024, now they are saying September 2024. It is taking way too long, we started talking in September of 2022. The design is nothing more than replacing what we have with a few exceptions. We don’t like the design and have expressed this multiple times. The builder said he had other clients that bumped us.

    Post your contract (names/addresses redacted) and what state you are in. State laws vary. Begin looking for a lawyer in case you need to go that way. I assume that you made your objections to the date change to the builder?

    Yes we have stated the dates were not acceptable. Yes we are contacting a lawyer. Thank you!

    Why? Have they been cooking grilled cheese sandwiches on it at lunchtime? If it's still new /in storage, it's still new.

    Consider the times in which we live: During the pandemic appliances were what my engineer husband calls "Unobtanium" -- something you just can't get for any price or effort. We had to buy a washer/dryer during the heart of the pandemic, and we were forced to go with our 4th or 5th choice.

    With that in mind, I am not surprised that designers /builders are trying to grab appliances when they're available. We're not solidly out of Unobtanium land just yet.

    I don't have any personal knowledge about this, but those "prestige brands" do behave like they can do anything they want. Because they can. So this rings true.

    Yes, that is a big concern.

    Sometimes yes, sometimes no. Did you specifically discuss this with your designer /builder?

    I'd be furious at a delay of this length! However, you say you don't like the design? Do you have a solid design on paper? Is that why they're delaying you?

    There are so many red flags here. You are over $100K in and he's bumping YOU for other clients? He's used your money to fund other projects and your money is gone. I doubt your appliances are there either.

    Agree about the red flags and huge amount of money already paid.

    I would be curious to understand the design process? This is just a kitchen remodel and you are six figures in BEFORE construction has started? I don’t understand why appliances were ordered if a final plan wasn’t approved. Or did you approve a plan, they ordered appliances, they experienced delays with the schedule AND you got cold feet on the design? I can see design fees becoming astronomical if there have been multiple design revisions. This can be the result of client indecision and/or a clunky design. Speaking to a lawyer is good advice.

    We ordered the appliances before there was any plan. We were told to pick out what we wanted. The design was a simple replacement of what we have when we received it. The appliances are too much for the design. There is only one small drawer in the design with two drawers for pots and lids. We have a lawyer working on this. Thank you
