    The key word is "reputable".

The one nursery I found that offers it is an entity out of Portland, OR called HighGarden Roses.

However, their listing for 'Thierry Marx' is actually titled "French Florist Shrub Rose Inspired by Thierry Marx". Now, why would they say that, you may ask yourself? It's simple: they do not have license to propagate and sell 'Thierry Marx'.

If you read to the bottom of the listing, they acknowledge this fact: "*This rose is genetically the same variety as the rose commonly known as 'Thierry Marx'. Highgarden Roses does not own the trademarks for these rose names, nor are we affiliated with, endorsed by, or licensed by any third-party companies, breeders, or growers."

That last line in which they state that they do not have license to distribute ANY of the roses they offer is telling. Please do not support any nursery that knowingly sells varieties that they do not have license to distribute. All those wonderful Japanese roses that so many people drool over and gladly pay through the nose for? — it's extremely unlikely that the breeders are getting any of that sales revenue from sellers like this one.

@Kristine LeGault I don't know of any seller that is legally distributing 'Thierry Marx'. Sorry, I wish I could be of more help.

I did find several other sellers that — after a bit of research — turned out to be Etsy portal sites, selling the rose from China and shipping to the USA, so be careful to avoid those, as they are almost certainly shipping plants to the US without phytosanitary documentation. The importer is the one liable for fines in such instances, not the seller.

My child bought a rose from this company and was happy, Kristine. The child was not aware of legality issues.

Kristine, to buy this rose from a reputable source, you’ll need to wait until April & Ashley decide that it’s worth introducing to the U.S. market. Any other sellers at this point would be a gamble.

In your situation, Kristine, I would get that rose you want in Portland. I totally agree that Paul is right about everything but you have some stressors.

I would also go to the Casey Eye Institute in Portland if you haven't already.

I have a problem with buying roses from sellers like Highgarden Roses. They are stealing someone else's intellectual property. A rose someone else hybridized, put lots of time and work into, and these sellers are just taking that rose without paying a nickel to the rose breeder or the company the breeder works for, so they can grow it in China, and then sell it to us in the US. Paul said it better, but I'm so angry, I had to write how I feel, as a former designer, who was ripped off a time or two in the same type of racket. Diane

I just felt our friend has been through so much, I did not think she should not get the last rose she wanted.

Paul, I get what you’re saying, and as a rose breeder yourself, you are the one who has the authority to speak out on this subject. I am curious, though, about the roses they’re selling that are already out of patent. Is there any reason we shouldn’t buy these from HighGarden Roses? I just bought Juliet from them. From all that I found online, they are a registered nursery, and I see no reason not to buy roses from them that are not under patent anymore. But I’m open to hearing otherwise and would like to hear your thoughts on this.

Juliet has been out of patent for almost a year now, Judi. Patent applied for, Feb. 1, 2005. Twenty+ years is now up. No copyright restrictions.

@judijunebugarizonazn8 There is no harm being done by purchasing an out-of-patent rose, no. But this nursery also makes statements that clearly indicate that they are knowingly selling roses for which they have no license.

In the case of 'Thierry Marx', they are selling it under the heading of "French Florist Shrub Rose Inspired by Thierry Marx", and then stating that it IS 'Thierry Marx', but they are not licensed to sell it, so they are doing their best to circumvent the legal issues.

Buy 'Juliet' from them if you want — I'm not judging you. How you spend your money is up to you. I prefer to support nurseries that play by the rules is all.

I contacted Wabara to explain that I had unknowingly purchased several of their roses through a third party and was concerned that royalties may not have been paid. I asked if there was a way for me to make a payment or donation directly to the breeder to make this right. I did not receive a response.

Kristine, I can recommend Hillside Rose Farm — they sell Thierry Marx under Blueberry Cake name.

Paul, April & Ashley have secured the license to sell the majority of Delbard and Tantau roses in the U.S. Hopefully, they’ll recognize that offering the most sought-after varieties is essential; otherwise, demand will continue to be met through unofficial channels.

Sheila / Diane -- I understand and empathize with both of your views. I feel like it's an example of "two truths can exist at the same time." I bought Eisvogel from an Etsy seller at a time when I was feeling down and needed my spirits lifted. At the same time, I work in the arts and have deep respect for intellectual property rights. So, I feel for both sides. I wish we, as consumers and lovers of roses, weren't put in these moral quandries by sellers. I wish the onus rested on the sellers to keep things on the up and up.

(The soil the Eisvogel came in was rather buggy and I ultimately ditched the rose.)

Oh boy, it looks like I opened the proverbial can of worms. Ignorance can be bliss but that is not the case at this point. I always defer to Paul as a breeder who knows the system doesnt play fair and that bugs me, for the time and resources to create a new rose without the compensation that his his due.

Sheila, thank you for you kind thoughts. I guess that in the end it is just a pretty rose and there are lots of those, legally sold and compensated for. Fun to open the old can of worms again lol

    Kristine,

Do you grow Raspberry Cupcake? It's on my short list. Just going by my studying of all the info provided on the internet about Thierry Marx and Raspberry Cupcake that I could discover, I found the bush form to appear to be more refined and compact, and the flowers better formed with Raspberry Cupcake. The two, Thierry Marx and Raspberry Cupcake are so similar in color it would be hard for me to sort out a bouquet with both roses mixed together in it.

Raspberry Cupcake is available from High Country Roses, Colorado, which nursery I like to patronize even though the roses can come small, sometimes with their root mass separating from their potting medium when unpotted. Matt, the owner, is legit....such an easy fellow to speak to and 'brain-pick'. I got my much beloved Oh My from him at his recommendation, and am glad I did....what an easy rose to grow. He receives my custom whenever possible.

Thierry Marx develops a very unique color in cold weather. It’s not comparable to Raspberry Cupcake at all—just like you wouldn’t compare blueberry tones to raspberry ones. (“Blueberry Cupcake” is another name used for Thierry Marx.)

I'm going by all the photos that I've seen at every possible internet site.

Bloom color specifics, I will not debate. Climate, care given, time of year, even time of day all are at play regarding accurate color reporting.

Flower form, although still subjective, makes me give the nod to Raspberry Cupcake over Thierry Marx. There appear to be too many misshapen Thierry Marx blooms spotlighted as prime shots. Thierry Marxs' petals recurve awkwardly, in tight, narrow formations....just my observation for what it's worth. I suspect TM's petals are thin.

    Really?:)

    Late Fall

P.S. If April & Ashley bring this rose to the U.S., I will buy several. Not a single black spot all season—honestly, even better than the so-called bulletproof Kordes roses in my climate.

Agree Elena, Thierry Marx aka Blueberry Panna Cotta, is no Raspberry Cupcake! The deep black purple center is instantly recognizable. The bloom is thick petaled like a Meilland Romantica, not thin like an Austin English rose. Pic is blurry because it’s a screenshot from a video I made.
