Is there a lemon law for refrigerators?

My one-year-old Amana/Maytag bottom-freezer fridge completely conked out and it took the local appliance store (independently owned, not a chain) four repairman visits and two hellish weeks to fix it. Now exactly two weeks later it has conked out again and it will take them a few days before they can come look at it. I'm really, really tired of living out of a cooler and throwing away hundreds of dollars worth of food--I'm a food writer and do cooking demos and recipe testing and really rely on my fridge. I called Maytag and they won't do anything about it. I want this fridge fixed or replaced now and I'd hate to besmirch the appliance store in print in my column that runs in five local newspapers, but that's what I feel like doing. Does anyone have experience with this sort of thing? Is there anything I can do? Thanks much for any advice.

Lemon laws vary by state and only cover an appliance during the warranty period, which is one year. An appliance retailer has zero to do with warranty issues. That is between you and your manufacturer and suggesting that you blackmail the retailer because of your position is extremely unsavory of you. Your one year old fridge is past it's warranty period. The manufacturer's responsibility is done with, unless you purchased an extended warranty, and if so, your conversation should be with that company. If you did not purchase an extended warranty, then repair or replacement are your responsibility.

    Jerosoma,
My sympathy. Maytag is no longer a reliable maker of appliances. I found that out with our dishwasher. However, after an interesting few rounds with the local repair place, Maytag gave us a new dishwasher (the old one had been recalled, the repairman botched the repair, and after two months I contacted Maytag directly). Footballmom gave you good advice. I would add, take the name of each person you speak with at Maytag, e-mail to follow up each telephone conversation, and keep at it. Be sure that everyone at Maytag knows you are a food writer. The old saying is one satisfied customer tells a friend; a dissatisfied customer tells the world. Remind Maytag of this as a last resort.
Let us know how it comes out.

is this piece of garbage still under warranty? sounds as though it's not.

Regardless, I would write a certified return receipt letter to the CEO of Maytag or whoever the parent company is, and copy (certified, return receipt) every useless executive down the line (cooking appliance division head, that type of thing), and explain your repair history and experience (missed work, missed work opportunities, food gone bad, etc), making sure that you're communicating the fact that you've kept repair records, and tell them that you'd like them to buy back their appliance. Give them a timeframe for a response. 2 weeks is reasonable. and state that if you don't hear from them in writing within that timeframe that you'll be forced to pursue additional remedies.

obviously you should at that point be prepared to pursue additional remedies, but generally speaking companies don't want to go down that road, so they'll concede.

doing anything by phone is next to impossible, as these companies don't have any sort of real customer service escalation process in place. they do this by design, as they hope most people will just give up. and sadly, most do, left with very expensive appliances that simply do not work.

for what it's worth, after 1 year of trying to get past customer service of Thermador, whose customer service is notoriously horrid, I did the above. Within 3 days I had a full buyback, and went on to buy a Miele, which works great, and whose customer service actually seems to care.

Best way to get what you want is to file a suit against them in conciliation court! They will settle in a hurry because the cost of have someone representing them will be at least the cost of a normal refrigerator and it bad PR too!

I got nowhere with the retailer, the authorized repair company and with Whirlpool Customer Service regarding a refrigerator purchased on 1/18/10. It's now had 2 service calls and still not working. Now waiting for a part to be ordered. All the while my tenant is without a refrigerator. Very sad.

It looks like the answer to the question is no, I was hoping that the answer is yes.

My 2 1/2 month old Samsung French door refrigerator is giving us crushed and whole ice at the same time, even though whole ice is selected, we never use crushed ice.

I had one authorized service man tell me yeah we know about it these models will give you 30% crushed ice with your whole ice. I just won't believe that, plus it makes a loud sound once in a while like someone just pulled the trigger on a gun, and they know about that to, but didn't get the right parts to fix that either.

This is the second company that came to fix it, and it's two visits for each one of them, they came with the wrong parts the fist time so I called Samsung and asked for another company, the second company did the same thing twice, he left today and said he has to order the right parts again.

I'm thinking that if they come with parts that don't fit, or the wrong ones again I would like to go back to Loews and ask for another frig, I don't see how they can say no after all the tries they had to fix it.

Somehow I'm also thinking they will make it worse if they do replace these parts, because this guy was trying to take parts off the old part to put on the new part so it would fit, but it didn't work, so he has to order the correct ones again he said, but I'm thinking it will never be as good as factory built refrigerator was.

Other posters have had results by posting on the company Facebook page. But first, I'd try to get the issue resolved through the manufacturer. They should replace.

I remember when things weren't this way with only one year warranties allowed in the marketplace. Maybe this can be fixed like some of the other things that have changed. I hope this is a pendulum point.

Thanks for the advice, I will keep trying and if they can't fix it, I'll ask Loews for another one.

Because your refrigerator broke? Wouldn't it make sense to wait to see if they can fix it first?

We are continuing to deal with a GE, Profile frig. which is now 3 years old. We have had problems since the first year We have had numerous repair men out and same old crap...wrong parts, no shows, can't diagnose issue, etc. I would never purchase another GE Profile frigerator, however, it doesn't sound like there are many reliable ones out there.

You have to have 4 service calls .....then they will have you contact the manufacture....then you might have a case for lemon law

I have a 2 & 1/2 year old Samsung refrigerator. Did not even install icemaker. It Stopped cooling in refrigerator & accumulating ice on walls. Called Samsung. . First said would find Samsung appliance repair in my area. Then Called back week later to tell me later had no repair iin area.. & said would refund if I sent in purchase order. Again another 2 weeks call to say could & would not do this as out of warranty. Continued to send me from one person to another in hopes of finding a suitable answer. ... meanwhile needed to get another fridge for my tenant. I had read blog on many other complaints of Samsung refrigeraters... got so mad at samsung after many calls to tech.. that I ordered another Kenmore frige. Had delivered up in the hills. Now I have the old refrigerator that I am trying to sell to someone who might be able to repair.. now it is snowing & I have to do something with this lemon.... of a refrigerator. ..
