Socks - SpanishFly is absolutely right. These are plants that are native to the southern US (TX, right along the border with Mexico, although we keep tearing up their territories for new housing and pushing them out of the US). So, they are native plants to our country, yet it is illegal to possess one (even just as a plant, not for consumption) unless you're a member of the Native American Church and go through all the proper channels. However, you can feel free to own a San Pedro or Epithelantha micromeris or any one of the other mescaline producing Cacti. Stupid, antiquated laws - likely put in place by people looking to disrupt the Native American lifestyle way back when.
