Sorry to hear about your situation, unfortunately in cases like this there is not much can be done unless you take the proper steps before you file a lawsuit. I would consult with your attorney and see what your legal options are.

But in general before you take your contractor to court, you have to do the following:

• Take pictures of bad work or what work remains unfinished.
• Keep all communications between you and the contractor in writing, i.e. text messages, send emails, send certified mail, etc requesting to repair "bad" or unfinished work.
• If the contractor will not return after he is given a reasonable timetable to correct and finish the work, you can hire a new contractor to fix everything and after that take legal action against the previous contractor.

Some states have Consumer Protection Laws, I would contact Attorney General and see if they can help you. Some cases can lead to Felony Charges.

That being said, I was involved in a few situations like this when I was called to complete abandoned work by others, and people successfully litigated their cases and got their money back and in some cases were awarded more, but this cases involved Code Violations, Hazardous conditions, Tear-outs, etc.

Some cases their attorneys advised them it wasn't worth to take legal action because it wasn't enough there and it would be a waste of time and it would cost them more money, so they just took their losses and paid to fix and finish everything.

Do you have any pictures of what they did or unfinished... If you do, please post a few maybe some items can be fixed without going through all the trouble.
