Frigidaire Pro all fridge freezing food?

We purchased our fridge in Nov 2016 but didn't install in new construction home till March 2017. A month or so ago I noticed food being weird. (yogurt was super thick for example) It is freezer our food. We put a thermometer in it and noticed that sometimes it will be 40* and other times it will be 25*.


Called the store we purchased from and they don't have a service tech right now so they referred us to a different place. That tech came out and acted like he had never seen this model before. Said we needed a new board and we are no longer under warranty. Charged $89 service fee. Then came back and said not sure about new board maybe needs something done with freon?? He is not certified to do that so we would need to go with ANOTHER company and our original $89 wouldn't go toward them because it's a different company. I reminded him that it is freezing things and he said he got his notes mixed up. My dh figured out from googling that it needs a thermistor. Tech agreed but then said needs both thermistor and board. (this is the short version LOL) I told him that I didn't see any reason to do a new board if it wasn't needed. Well that's fine but if we do need a new board we have to pay another $89 service fee for him to do that.


After some googling and phone calls it turns out this tech isn't a certified Frigidaire tech. So we called the certified place. They said they don't do warranty work because Frigidaire doesn't pay enough to cover. They will send a tech out (for $95 fee) and see what the problem is. I don't really even understand if they will turn it in as warranty or what.


What is a consumer supposed to do here? I'm so frustrated.
