Actually, that would probably be considered a decorative wall. The railing would be on the solid wall on the right. Most home inspectors would cite current building codes, but resale homes built before current building codesmight not be subject to retrofit for things like this. For example, bannister now need to be a certain hieght and spindles need to be a certain distance apart; very different if it was being built today vs. several years ago.
