PB claiming bankruptcy

Just when we thought things can't get any worse, we were recently notified that our pool builder Konen's Kustom Pool & Spa in Yuma Arizona has closed their doors and is claiming bankruptcy. He is abandoning approximately 12 pools that he have not been completed.

Currently, the pool has no leaks, but has several cracks in the plaster, ALLOT of mottling, it has never been balanced, the equipment is not working properly, we have 3 pumps, only 1 is working, the self cleaning jet's are ruined from all the acid, the water is green and dirty. We don't know what to do, we have asked another pool company to come take a look at it, and tell us what needs to be done to get things in working order. I have a feeling the plaster has to be chipped out again, the jet's have to replaced, God knows about the plumbing, what a nightmare. We have paid $102,000.00 for this pool, have been stressing over it for 11 months and now this......Sigh, we will pursue the insurance company and see what will happen next. Anyways, sorry it seems I am always the bearer of bad news. Thanks for reading this far, hope everyone is well.

You might be able to talk to the plaster sub directly. If they are not out of business they should warranty their work. Try to talk to ALL the subs directly.

Sorry for your situation. Be the first of the 12 to get on the insurance list. Stay on them and get all your ducks in a row. The insurance, if they will pay, will be fully aware of what their loss is and will try to cut a deal. Hold out for as much as you can without losing out. Not sure how the bankruptcy covers all this. Whatever you do, make sure you stay on this. Good luck.

I live in Yuma and am so sorry to hear about what happened. I just built my pool this summer and went through much ridiculousness as well. My neighbor went with Konen and also had issues. I live in Yuma Foothills.

Try to get bids, e-mail me if you want info on whom I found helpful and whom I didn't. I'm still working on getting things fixed as well.

Muddyboot, thanks for your reply, unfortunately Konen was the one who did our plaster, both times, lol.

Shannon, thanks for your reply, we will do just that, it is top priority for us. We just became aware that a lien can be placed on our home by unpaid vendors, this really sucks, that he can claim bankruptcy and get away with this while we have to suffer for thier negligence and irresponsibility. I am livid!

Just wanted to wish you luck in pursuing this.

I've followed your saga, firstly because you're tina bina bo-bina to my banana fanna and that always made me laugh.

Second, because your pool design is one of the most intriguing I've ever seen. It has the potential to be incredible and I hope it is soon.

I'd love to see pictures of tina's pool but can't get her link to work. Can anyone post them? i am interested in seeing the island in the pool, it sounds awesome. Thanks Barb

I didn't get your e-mail and I checked all potential files at which the e-mail could have been diverted (spam, etc). I hear there's a run on Konen's at the contractor's office. Also make sure you have a claim filed there. You'll need that to get any potential bond money back to you as well. Contractor's office is on the corner of 4th Ave and 24th street on the side of the building near the Coffee Bean and Church's.
