You could take them to small claims court probably, but you'd have to evaluate the cost of doing that vs. the cost of just insulating it yourself (or having someone do it). Actually it sounds like you already had it done so you know what the cost was.

Wonder what else is wrong with the house that you haven't found yet.

I have a copy of the building permit and they signed that the insulation had been installed in the attic. It wasn't done, so I'm assuming it was forgotten, or was not checked. Yes I've had it done already, when I mentioned it on "Twitter" the building company quickly had an insulation company sent out. Now I'm looking to see if this huge difference in the cost of electricity could be refunded. I was paying over 300 a month for electricity when now my bill is averaging 160.

CO = certificate of occupancy.

You can try to file a claim in small claims. There is really little to lose other than your time. I would think the fact that the builder came out right away to fix it shows that they knew they had messed up, so it is reasonable that they make good for the excess costs you incurred. Of course proving that exact amount might be difficult.

I hope this works out for you - I just can't imagine not even doing my head in my attic for 3 years - or, more accurately - "never" since moving in... I am nosy - I look EVERYWHERE during a new house build and once moved in.
