Insulation Permit Violation

Hi all, so I had a home built in Florida, and stupid me, I did not get a new home inspection. Fast-forward 3 years and I realized no insulation was put in the attic. The insulation permit was signed on the build date and forwarded to the City which I have copy of. I've been paying 3 years worth of 300+ electric bills thinking it was the norm, until the issue was fixed. My question is...Is there any violation or punishment for the builder for doing this? Could I possibly get back the over payment, should I take legal actions or consider it a lost? Any advice would be great!
