Best thing to do is to run by your ideas with the condo board.

I'm not sure what area you're in but here are the steps you should take.
1. Call your local building and permitting office and ask if a building permit it necessary.
2. Ask you ARB or HOA if you're required to submit a site plan and plans for a pergola in order to build it. Fees for a submittal may apply.
3. If they require plans then you can hand draw the location (to scale) on your site plan. You should have a site plan in your bank paperwork or there may be a site plan or survey at your local zoning department. You then can submit the site plan and sketches from the company you're ordering the kit from.
4. This same steps applies if you're required to apply for a permit. Permitting fees will also apply.

Being that this is a DIY kit you should not be required to hire a designer, architect or builder.
A lot of times the restrictions about the size of structures in neighborhoods are due to keeping lot coverage down to a minimum. Therefore the fact that its not a fully covered structure it a mute point. An open deck would likely have the same size restrictions. Good luck!

"Covered construction" refers to any structure (shed, pergola and the like) that is permanent, with posts secured in the ground with concrete. Follow the instructions above @Crosby Creations and you'll be in good shape.
