The backsplash looks like a variation of 'multi stacked slate'. Several tile manufacturers carry multi colored slate and this one is a brick pattern.

Sure, the sealer we used was a color enhancing sealer from The Tile Shop. It darkens the stone, and brings out a color that makes the stone look almost wet. When getting this for our client we were told it is oil based, which in turn is a little thicker to apply but lasts longer. This is the one we used: http://www.tileshop.com/product/productdetail.aspx?familyID=1936&recordID=5044678 To get a good idea what tile would look like sealed with color enhancing sealer, just take a wet rag and wipe down a few pieces with water. The wet stone should look pretty much the same. Hope this helps!
