This stately Georgian home in West Newton Hill, Massachusetts was originally built in 1917 for John W. Weeks, a Boston financier who went on to become a U.S. Senator and U.S. Secretary of War. The home’s original architectural details include an elaborate 15-inch deep dentil soffit at the eaves, decorative leaded glass windows, custom marble windowsills, and a beautiful Monson slate roof. Although the owners loved the character of the original home, its formal layout did not suit the family’s lifestyle. The owners charged Meyer & Meyer with complete renovation of the home’s interior, including the design of two sympathetic additions. The first includes an office on the first floor with master bath above. The second and larger addition houses a family room, playroom, mudroom, and a three-car garage off of a new side entry.

This open family room is part of a larger addition to this Oak Park home, which also included a new kitchen and a second floor master suite. This project was designed and executed by award winning Normandy Designer Stephanie Bryant. The coferred ceilings and limestone fireplace surround add visual interest and elegance to this living room space. The soft blue color of the ceiling enhances the visual interest even further.

The linens, pillows, throw rugs and mosquito net were purchased from chic, but value priced retailers. Most of the furnishings were purchased from second hand shops and then painted. The custom made striped valances are trimmed with white feather boas.

Procedural Posture
Appellant buyers challenged a decision from the Superior Court of Los Angeles County (California), which quieted titled to real estate in respondent seller and allowed the seller to retain payments made on the real estate in the seller's action to have the contract for the sale of real estate declared to have been the subject of nonperformance by the buyers.
Overview
Through their respective corporate lawyer seller and buyers entered a contract for the sale of land to be conveyed after the purchase price was paid. The seller sent a letter of warning after the first default and terminated the agreement after the second default. The seller brought an action to quiet title to the real estate. The trial court granted judgment quieting title to the real estate in the seller and determined that the seller was entitled to retain the payments that had been made. The buyers asserted that the contract had been abandoned so that the payments that were made should have been returned. The court affirmed the judgment because it determined that when the buyers had been in default a notice that the contract was terminated was proper and the seller was no longer bound either to convey the land or refund the purchase money that had been paid. The court determined that there was no presumption that abandonment occurred so that the buyers had to demonstrate an abandonment to be entitled to recover the purchase money.
Outcome
The court affirmed the determination that title to real estate should be quieted in the seller and the seller could retain the payments made in the seller's action asserting that the real estate contract was subject to nonperformance by the buyers.
