We have not registered any seedlings yet but my understanding is the person who first flowered the seedling has the right to register it. If you buy seeds and grow and flower them, you are the breeder.

It's a little different if you buy seedlings. Unbloomed seedlings are yours and you can register them with your name only as the breeder.

If the seedling has flowered before, the person who flowered it has the right to register unless they sell all of it to you and give you permission in writing (by signing the correct registration form) to register it. Then both the original grower's name and your name will be listed in the registration.

If they sell only part of the seedling (bloomed or unbloomed) to you, you cannot register it.

Sometimes sellers will tell you that bloomed seedlings are yours to do with as you choose. You could register it with just your name. I can understand this. I wouldn't want my name on something that I didn't personally help select.

If I don't mistake, in the former Soviet Union the authorship of fe new fruit tree varieties was divided between the hybridizer and the person who grew the seedling up to fertile age. And this actually is quite logical - choosing parents for good crosses needs more knowledge and experience than just growing up the resulting seedlings.

I hybridized daylilies for many years but never tried to register one. The reason was that I sold them on the internet and at Farmer's Markets and no one seemed to care whether it was a registered name. As long as they saw the picture (and the name I put on it) and liked what they saw, they bought. After 20 years of doing it, my favorites were the ones I hybridized myself. Unfortunately, the buyer of my farm got everything since our place finally sold in the middle of winter after being on the mkt for almost a year. So now, I plan to start from scratch. Anyone have seeds?
